Attorney Lisa Shoman Provides Interpretation of CCJ Decision

Lisa Shoman

Senior Counsel Lisa Shoman, who has an interest in the outcome of the matter, sat in on the decision this morning.  She represents Caleb Orozco of UNIBAM who is also filing a constitutional challenge in the Supreme Court in respect of section fifty-three of the criminal code.   Following the judgment, which was delivered via teleconference, Shoman shared a brief interpretation of the CCJ decision.

Lisa Shoman, Attorney for Caleb Orozco

“What the court has ruled is that Mr. Tomlinson’s rights were not abrogated by this state, really because he didn’t come here and wasn’t denied entry.  My sense however, is that had Maurice Tomlinson come to Belize and had he actually been denied entry on the basis of being a homosexual then there would have been a live issue in terms of the Revised Treaty of Chaguaramas.  And my belief is that the decision in Myrie would actually dictate that Belize’s domestic law cannot stand up in terms of CARICOM nationals if it is refusing CARICOM nationals entry on the basis of being a homosexual.  So that will remain to be seen.  Knowing Mr. Tomlinson I am sure he is not going to be content to simply leave this as is.  It is a novel point of law however as it is interesting and important.  I remind all of us that we still have the Caleb Orozco matter outstanding for decision in Belize, that’s been some three years now and we’re seriously hoping that we’re going to get a decision very soon in that matter because these are the things that help to develop the jurisprudence in the Caribbean.”
