A Nolle Pros in the Case of Helen Yu’s Murder

Turning to the courts…On August twelfth, 2010, fourteen year old student of Edward P. Yorke High school Helen Yu was shot and killed during a robbery at her father’s shop on Iguana Street in Belize City. Three men were charged for her murder: Jermaine Matura, Arlington Drive and Egbert Miller. After a case management today, the Office of the D.P.P. conceded that there was lack of evidence against the men and a nolle prosequi was filed to set the men free. Outside the court room, the mother of Jermaine, Lisa Matura, was present along with relatives of the other men who were all whisked away.  Attorney Bryan Neal explains how the case fell apart:

“There is an interesting feature of the new civil procedure and practice rules whereby you do case management to see if these cases are cases that should really go the full length. What happened in this case, we took advantage of that rule that was just brought into force this year and this is one of the few groundbreaking cases that has allowed us to look at the case before it went to court. There was the problem with witnesses, there was the problem that there were certain identification issues; there were several problems that I found on the file and we submitted to the court that in the case management, it really didn’t make any sense for us to proceed. The prosecution was to reply to our submission to say why they felt that the case should proceed, but today they informed the court instead that they do not want to proceed so the people, as you said, have walked.”

“Sir on the face of paper, the evidence wasn’t there?”

 

Bryan Neal

“There was never the evidence, but the main problem as I see it was that there were some witnesses who had left the jurisdiction. The young lady…her parents left shortly after the incident—no doubt because of her death, they left Belize—and they were never contacted. Their statements could not be admitted and it would have been a waste of time to take this matter to court.”

“Do you have the particulars of that shooting incident?”

 

Bryan Neal

“Well the allegation that some Belizean males, dark-skinned males, entered a Chinese shop on Iguana Street carried the family into the back of the shop and shot the daughter of the proprietor of the Chinese Shop. That is what was alleged but it was never proven or there was never enough evidence against my client and no doubt that is why the D.P.P. has now thrown in the towel.”

 

The murder stunned the Asian community which held a shutdown of businesses in protest of the murder.  The Yu family left Belize after the death of their daughter.
