Firearm Charges Against Joseph Nunez Struck Out in Court

In June 2014, a prosecutor with the Municipal Court was arrested and charged for two firearm offenses after he claimed he stopped a friend from committing a serious crime by taking his gun into safe keeping. Joseph Nunez was charged for Kept Firearm and Ammunition without a Gun License.  But that is now behind him because in the courtroom of Magistrate Herbert Panton, the charges against Nunez were struck out after the witness for the prosecution was nowhere to be found. In June, 2014, there was a domestic dispute between a friend of Nunez and his girlfriend.  During the alleged domestic dispute, a nine millimetre pistol loaded with fifteen live rounds of ammo was introduced. But before Nunez could take the firearm to the police, he was detained. Our court reporter got a reaction from Nunez and his attorney, Leeroy Banner as they exited the court.

“For the past year or so, Mister Nunez has been coming to the courts so that his matter can be disposed and each time he came to court, the crown seek an adjournment. And today, he came for trial and none of the witnesses were in court and I made the submission that the matter be struck out and the magistrate adhered to my submission and Mister Nunez’s matter was struck out due to the lack of evidence.”

 

Reporter

“Give us the details aobut what was the charges levied against your client?”

 

Leeroy Banner

“The charges was kept firearm without license and ammunition as well.”

 

Reporter

“Can you say what happened prior to those charges being levied?”

 

Leeroy Banner

“Well basically what happened, there was a domestic dispute and Mister Nunez was a Good Samaritan and he intervened and secured the firearm. He called a friend at precinct one on Euphrates Avenue and he was on his way to take the firearm for safe keeping. While he was on Raccoon Street going towards the canal side, he was stopped by two police officers. Immediately he handed over the firearm to these officers and said he was taking this gun for safe-keeping. And based on the narrative, he was arrested and charged. So even though he was trying to be a Good Samaritan.”

“How does it make you feel today that you have been vindicated of the charges?”

 

Joseph Nunez, Freed of Firearm Offenses

“At least a weight has come off of my shoulders now and I could move on with my life.”

 

Reporter

“What happened with your job though?”

 

Joseph Nunez

“That’s a different story.”

 

Reporter

“So what next for you?”

 

Joseph Nunez

“Plan B.”

 

Reporter

“Do you plan to sue anyone? Take anybody to court on this matter?”

 

Joseph Nunez

“Well I left it up to my attorney. We will talk over it and we will see what will be the next step.”

 

According to Attorney Leeroy Banner, the case brings to light that the gun law is draconian and needs revisiting.
