Smith Walks Free in Double Homicide Trial

Twenty-seven-year-old Jaimie Smith walked free from the double murder that claimed the lives of Eric Arana and Dwayne Tillett on Antelope Street Extension four years ago The acquittal took place just before ten thirty this morning, before Justice Adolph Lucas in a trial by judge without jury in which the judge was the judge of the law and the jury of the facts. The case started on June twenty-third and concluded in trial last week July seventh, where his judgment was deferred today. Prosecutor in the case was Porshia Staine of the D.P.P.’s office and Smith was represented by attorney Bryan Neal.

“Well, he was acquitted this morning because the main witness, there was one main witness, because we tested his evidence in cross-examination, we realized that he couldn’t have seen what he said in the statement that he saw. Basically, the evidence in terms of the identification of the shooter could not hold up in court so that the judge would be sure that in fact my client, Jamie Smith, was the trigger man on that day. So, based on the reasonable doubt that was established on the defense side, which led the judge not to be sure and as such was forced to order an acquittal.”

“What was the crown’s main witness statement versus his testimony? Because we know he was treated as hostile?”

“In his statement he said that the area was well lit and that he was able to see the shooter. Once I cross examined the scenes of crime personnel and another eye witness who was also shot but not fatally, it became clear that this person didn’t see what he said he saw. I made certain submissions to the judge in my closing arguments and even though he picked out someone from the ID parade, we submitted that he was mistaken when he picked out that person because he couldn’t see who was the original shooter, so if you can’t see who was the original shooter, then certainly whoever you picked out of the ID parade will be equally flawed and I think that is what the judge accepted.”

    This was witness intimidation as usual.Hence the reason the crime rate is going to continue to increase.
