BGYEA Back in Court

The case of the Government of Belize and Belize Grassroots Youth Empowerment Association (BGYEA) returned to court. When last we left it, Justice Courtney Abel had scheduled mediation between the two parties as a way to solve the dispute. BGYEA wants to go through with a project to plant corn in what Government claims is a road reserve, but has halted activities because of the court-ordered mediation. Attorney for BGYEA, Audrey Matura-Shepherd, updated the results of today’s case management conference, where there was a change of attorney but no change of mind by the judge about the way forward.

“Well, what happened in chambers today was that we had to revisit some of the court orders previously given. When I last updated you all on this matter, the court had ordered mediation and we should have gone to mediation by the sixteenth of September, however, that never happened, for different reasons it didn’t happen. One of them being that the government changed their attorneys, so although Mr. Hawk is holding brief right now, we got a notice that the new attorney is Mr. Rodwell Williams Senior Counsel. So Mr. Hawk was waiting for further instructions from his clients meanwhile we sent in the names that we had suggested we would want as a mediator. The court told us today that there is absolutely no way they will allow a court order which they have issued for mediation to be disobeyed and so extended the time for mediation.  We have been given up to the twenty-eight of November to go to mediation; the court has since appointed a mediator so that is no excuse not to go to mediation. Well what we do now is that we start preparing to go to mediation, when you go to mediation the mediator gets to see all the documents before you go to court so there are certain documents we are gonna file. We are going to wait for the claimant to file a response to our defense because we have filed a defense. Based on that we will find out if there is any further affidavit that we need to submit and then we will do that. Another thing we will as for Mr. Sam Patt on the second defendant removed because he is not really a party per say in the matter, so all of that will happen we will know where it goes after the mediation.”
